FREIGHT TERMS & CONDITIONS
Coast to Coast All Transport, Inc.
Effective Date: January 1, 2025
Coast to Coast All Transport, Inc. (“Carrier,” “we,” “our”) provides transportation services pursuant to these Freight Terms & Conditions (“Terms”). By tendering freight, the shipper or customer (“Shipper”) agrees to these Terms.
1. Governing Rules & Carrier Status
Carrier operates solely as a motor carrier under its own USDOT and MC authority.

Bill of Lading (BOL)
FMCSA regulations
Carmack Amendment (49 U.S.C. §14706)
49 CFR §370
Carrier does not act as a broker under these Terms.
2. Rates, Quotes & Adjustments
Rates are based on shipment information provided at quoting.
Quotes are valid for 24 hours unless agreed otherwise.
Misdeclared freight may result in rate changes or refusal of service.
Market-based surcharges may apply.
3. Accessorial Charges
Examples include:
Detention (after 2 hours)
Layover
TONU
Redelivery
Reconsignment
Multi-stop charges
Driver assist
Hazmat handling (with prior approval)
Storage
Liftgate or special equipment
4. Pickup & Delivery
Shipper must provide complete details including addresses, appointment requirements, operating hours, and restrictions.
Carrier is not liable for delays related to:
Facility conditions
Lack of equipment or labor
Incorrect instructions
Excessive wait times
Drivers are not required to load/unload unless agreed.
5. Freight Description, Packaging & Loading
Shipper must ensure:
Accurate commodity description
Proper packaging, blocking, and bracing
Compliance with DOT and safety regulations
Correct classification (if applicable)
Right to Refuse Unsafe Freight
Carrier may refuse or discontinue service for freight that is unsafe, overweight, improperly packaged, or non-compliant.
6. Cargo Liability & Claims
Liability follows the Carmack Amendment.
Carrier’s liability is limited to $100,000 per truckload unless otherwise agreed.
Carrier is not liable for:
Acts of God
Weather delays
Concealed damage not noted
Improper packaging
Shipper/consignee handling
Temperature claims unless contracted
Delays or consequential damages
Claims Requirements
Visible damage must be noted at delivery.
Concealed damage reported within 48 hours.
Formal claims filed within 9 months with full documentation.
7. Delays & Service Guarantees
Transit times are estimates; delays may occur due to factors outside Carrier’s control.
Service Limitation Disclaimer
All transit times, delivery windows, and performance estimates are approximations and not guaranteed. Carrier shall not be liable for delays caused by weather, road closures, inspections, mechanical issues, shipper/consignee readiness, or circumstances beyond its reasonable control. No consequential, incidental, special, or punitive damages will be honored.
8. Hazardous Materials
Hazmat shipments must be pre-approved and fully documented.
Improper or undeclared hazmat indemnifies the Carrier entirely.
9. Payment Terms
Standard payment terms: Net 30 days.
Late payments may incur service charges.
Carrier may suspend service for past-due balances.
Shipper responsible for collection costs and attorney fees.
10. Indemnification
Shipper indemnifies Carrier for:
Improper packaging
Misdeclared freight
Improper loading
Hazmat violations
Fines caused by shipper actions
11. Force Majeure
Carrier is not liable for inability to perform due to natural disasters, government actions, labor disputes, terrorism, or transportation network disruptions.
12. Governing Law & Venue
These Terms are governed by California law.
Any disputes shall be resolved exclusively in San Diego County, California.
